impactAlert: EEOC Opens 2024 EEO-1 Data Collection with Shortened Filing Window

The U.S. Equal Employment Opportunity Commission (EEOC) 2024 EEO-1 Component 1 data collection period has opened (as of May 20, 2025) and will close on June 24, 2025, providing employers with a condensed five-week window to submit their workforce demographic data.

(Important note: no additional 2024 EEO-1 Component 1 report(s) will be accepted after 11:00pm EST, Tuesday, June 24, 2025.)

This marks a significant reduction from previous reporting periods, emphasizing the need for employers to prepare promptly to meet the deadline.

A notable change in the 2024 reporting guidelines is the elimination of the option to report non-binary employees. The EEOC’s proposed Instruction Booklet specifies that only binary gender options — male and female — are available for reporting employee counts. This adjustment aligns with Executive Order 14168, reflecting a shift in the federal approach to gender classification.

In addition, the EEOC’s proposed 2024 Instruction Booklet continues to require federal contractors with 50 or more employees to file EEO-1 reports. This indicates the EEOC’s intent to maintain certain reporting requirements for federal contractors. This also is independent of Executive Order 11246, rescinded in January 2025, which previously mandated nondiscrimination and affirmative action obligations for federal contractors.

Employers are advised to review the updated reporting requirements and prepare their submissions accordingly to ensure compliance within the shortened reporting timeframe.
